1. Agreement to Terms
By accessing or using the NextCall Systems website (nextcallsystems.co) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our website or services. NextCall Systems is operated by NextCall Systems, LLC, located at 701 W Route 70, Suite 1044, Marlton, NJ 08053.
2. Description of Services
NextCall Systems provides virtual receptionist and automated call answering services designed for home service contractors, with a focus on water mitigation and restoration companies. Our services include:
- 24/7 automated call answering for incoming customer calls
- Emergency call detection and prioritization
- Instant contractor notification via SMS and email
- Caller information collection and customer follow-up
- Integration with your existing CRM and business systems
3. Paid Services and Billing
After the free trial, continued use of NextCall Systems requires a paid subscription. By subscribing to a paid plan:
- You agree to pay the monthly subscription fee associated with your selected plan
- Billing occurs on a monthly basis from the date of subscription
- Payments are non-refundable except as required by law
- We reserve the right to change pricing with 30 days' written notice
- Failure to pay may result in suspension or termination of services
4. SMS Communications
By providing your phone number and using our services, you consent to receive SMS/text messages from NextCall Systems, including but not limited to:
- Service-related notifications and updates
- Call alerts and call summaries
- Appointment updates and follow-ups
- Account and billing notifications
Recurring Messages Disclosure
By opting into our SMS program, you authorize NextCall Systems, LLC to send recurring text messages to the mobile phone number you provided. Depending on your service selection, you may receive regular recurring messages.
Consent Is Not a Condition of Purchase
You are not required to agree to receive recurring messages as a condition of purchasing any goods or services from NextCall Systems, LLC.
Third-Party Sharing
We will not sell, rent, or share your phone number with third parties or affiliates for their marketing/promotional purposes. Your consent to receive SMS messages is not a condition of purchasing our services.
Message Frequency & Rates
Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Opting out of SMS may limit certain service features that rely on text notifications.
Carrier Liability
Carriers (e.g., T-Mobile, AT&T, Verizon) are not liable for delayed or undelivered messages. NextCall Systems, LLC is not responsible for any issues arising from carrier network failures or limitations.
Age Restriction
You must be 18 years of age or older to opt in to receive SMS messages from NextCall Systems, LLC. By providing your phone number and consenting to receive messages, you confirm that you are at least 18 years old.
Content Compliance
Our SMS messages will never contain phishing attempts, social engineering to manipulate you into sharing private information, or illegal content. All content complies with federal and state laws. We do not send SHAFT content (sex, hate, alcohol, firearms, or tobacco) that does not follow federal and state laws and regulations.

5. User Responsibilities
As a user of NextCall Systems, you agree to:
- Provide accurate and complete information during registration
- Maintain the confidentiality of your account credentials
- Use the services only for lawful business purposes
- Not misrepresent the nature of the automated call answering to your callers in a way that violates applicable laws
- Comply with all applicable federal, state, and local laws and regulations
- Notify us promptly of any unauthorized use of your account
6. Service Availability
While we strive to provide 24/7 service availability, NextCall Systems does not guarantee uninterrupted or error-free service. We may experience downtime due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.
7. Limitation of Liability
To the maximum extent permitted by law, NextCall Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of business, or loss of data, arising from your use of our services.
Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount you paid to NextCall Systems in the twelve (12) months preceding the claim.
NextCall Systems is not responsible for missed calls, failed notifications, or lost customer inquiries resulting from technical failures, carrier issues, or circumstances beyond our reasonable control.
8. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the services will meet your specific requirements, that results will be accurate or reliable, or that the service will be uninterrupted.
9. Intellectual Property
All content, features, and functionality of the NextCall Systems website and services — including text, graphics, logos, and software — are owned by NextCall Systems and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Termination
Either party may terminate the service relationship at any time. You may cancel your subscription by contacting us at [email protected]. Upon cancellation:
- Your service will remain active until the end of your current billing period
- No refunds will be issued for partial months
- We will retain your data for 30 days after termination, after which it may be deleted
We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in conduct that we determine is harmful to our business or other users.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Burlington County, New Jersey.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
